Human Right To Environment
Abstract
It is not strange that the international and national efforts focus on human beings, the environment, and the relationship between them. Therefore, the starting point in protecting the environment is the recognition that humans have a right to exist in a livable environment: the human being has the right to enjoy a clean, sound, and balanced environment, and at the same time, he must refrain from doing anything that may result in damage to the components of the environment, refraining from harming the environment is a right and a duty towards the environment that is inseparable from everything related to environmental protection. The international documents concerned with protecting Human Rights (HRs) have paid attention to this right, whether at the international or national levels. This research aims to investigate some legal aspects of this right in terms of its definition, and characteristics, demonstrating its sources and its legal basis, as well as the persons who enjoy this right. These points contribute not only at the national level but also at the international level to exploring and revealing how to protect this right.
